Usually when people think about importing drugs from Canada, a red flag pops up in there mind that reads, ILLEGAL. However that is not the truth or not the whole truth at least. Everybody knows that you can buy prescription drugs from Canada for much less than here in America. What stops them is fear that the government will confiscate their medication or that they will be caught breaking the law. But is it really breaking the law? In 2003 the government passed a drug importation law that made it legal to purchase prescription medication from Canada and England as long as the prescription was a personal amount (90 day supply or less). That law enforced a law that was created in 1954 that allowed consumers to by small personal supplies of prescription drugs from foreign sources.

Although this may sound like it answers our questions but there is much more to it. The FDA has set up other regulations trying to prohibit you from importing cheaper medications, in other words a catch-22. The FDA states that they dont allow importation from Canada because they cannot guarantee the safety of their drugs. They also say that the risk of counterfeit drugs is much higher but guess who is the number one importer of prescription medication from Canada? You guessed it, the United States government. The government uses the medication to provide cheaper medication to our troops, as well as on foreign aid projects. The real reason the FDA doesnt want foreign drugs to affect American drug market is so they can keep their monopoly on our drug market and continue to charge higher prices.

The FDA does seize a small amount of the drugs imported from Canada most being orders that are controlled substances or that exceed the 90 day personal supply. Sometimes even the regular order that follows the guidelines is confiscated. This is mainly due to the catch-22 type laws that are interpreted differently by different offices and inspectors.

So is it legal? The bottom line is yes. Even if your package is confiscated you will not be charged with any crime or have any legal action taken on you as long as you are ordering a 90 day supply that is not a controlled substance.
